SC rings alarm bells for chronic litigants


NEW DELHI: The publicity hungry who rush to higher courts with public interest litigations based on newspaper headlines were put on warning on Friday after the Supreme Court refused to interfere with an Allahabad High Court order asking a persistent PIL litigant to deposit Rs 25,000 with every PIL she filed.

The incessant petitioning by Nutan Thkaur on purported public causes made Allahabad HC impose a novel condition - deposit Rs 25,000 with every fresh PIL she filed. If the court found the PIL to be advocating a genuine public cause, then the money would be returned to her. If not, the amount would be forfeited. She has so far filed a record 86 PILs in the HC.

Thakur's counsel Anoop Chaudhary argued that the condition imposed by the HC amounted to stifling the petitioner's important right to seek judicial redress of her grievances against the executive.

But a bench of Chief Justice R M Lodha and Justices Kurian Joseph and R F Nariman found nothing wrong in the condition imposed by the HC. It said, "There is nothing extraordinary about this order. All that it asks you to do is to deposit Rs 25,000. It does not curtail your right to file a bona fide PIL. It is only to ensure that you don't henceforth file frivolous petitions."

The bench was aware of the problem of frivolous litigation in the Supreme Court which has imposed cost on several PIL petitioners for rushing to the court with a PIL based on newspaper reports. If it found the PIL to be genuine yet lacking in data, it often asked petitioners to do more research and come back with statistics to back their claim.

The bench said there was a need for a law in every state to curtail vexatious and frivolous litigation. "In Maharashtra, there is a Vexatious Litigation (Prevention) Act of 1971 that needs to be enacted by every state," it said.

The bench said, "No one can rush to the court with a PIL for every headline in newspapers."

But Chaudhary argued that the court could always dismiss Thakur's petition and impose cost if it was found to be frivolous. "By this order, they will not entertain any petition by this petitioner unless supported by a demand draft of Rs 25,000," he said.

The bench said if her petition was genuine, she would always get her money back. The Law Commission had in 2005 recommended to the Centre to prevent frivolous litigation by enacting a law on the line of Madras Vexatious Litigation (Prevention) Act of 1949.

The commission was of the view that if a registrar general of an HC identified a litigant to be bombarding the court with petitions "habitually and without reasonable ground", then he could move a petition before the HC to declare him/her a vexatious litigant. Once that was done, he would be permitted to file a petition before the HC or a subordinate court only after prior approval from the head of that court.

खुलकर टैक्स चोरी कर रहे फोटो व्यवसायी : शिकायत प्रेषित

प्रिय मित्र ,

फोटो व्यवसायियों द्वारा खुलकर टैक्स चोरी करने के मामले में मैंने सेवा
कर के महानिदेशक, उत्पाद शुल्क और सेवा कर के आयुक्त ,वाणिज्यिक कर विभाग
के अधिकारियों समेत देश और प्रदेश के नीति नियंताओं को भी शिकायत
प्रेषित कर कार्यवाही करने की मांग की है l


दरअसल रक्षाबंधन पर मेरी बेटी ने रिटर्न गिफ्ट के रूप में हमसे फोटो
स्टूडियो में चलकर फैमिली फोटो खिंचाने को कहा l हम सभी ने राजाजीपुरम ई
ब्लॉक स्थित 'प्रेम कलर लैब एण्ड स्टूडियो' पर जाकर 6 फोटो खिंचाई और
मेरी बेटी ने 40 रुपये प्रति फोटो की दर से 240 रुपये और 10 रुपये प्रति
सॉफ्ट कॉपी की दर से 60 रुपये प्रेम कलर लैब एण्ड स्टूडियो के काउंटर पर
बैठे व्यक्ति को दे दिए l रसीद के नाम पर जब हमें एक पर्ची दी गयी जिस पर
किसी प्रकार के टैक्स आदि का अंकन नहीं था तो हमने पक्की रसीद की मांग की
l काउंटर पर बैठे व्यक्ति द्वारा भांति-भांति के बहाने बनाये गए और अंत
में कहा गया कि अभी रसीद बुक नहीं है और फोटो देते समय ही पक्की रसीद
देने का आश्वासन दिया गया l

कल शनिवार शाम मैं और मेरे पति फोटो और रसीद लेने गए l हमको फोटो और
सॉफ्ट कॉपीयाँ तो दे दी गयीं किन्तु पक्की रसीद नहीं दी गयी l जब हमने
इसकी शिकायत अधिकारियों से करने की बात कही तो प्रेम कलर लैब एण्ड
स्टूडियो पर बैठे लोग गुंडागर्दी पर उत्तर आये और बोले कि पक्की रसीद
नहीं मिलेगी, जहाँ चाहो शिकायत कर लो l प्रेम कलर लैब एण्ड स्टूडियो का
मालिक जैसा दिखने बाले व्यक्ति ने कहा कि उसके कई नेताओं और आईएएस
अधिकारियों से घरेलू सम्बन्ध है और वह अधिकारियों को लगातार घूस खिलाता
रहता है l उसने यह भी कहा कि उसके स्टूडियो पर छापा पद ही नहीं सकता है
l उसने कहा कि वह ही नहीं लखनऊ का कोई भी फोटो स्टूडियो पक्का बिल नहीं
देता है l

मेरे अनुसार इस प्रकार की टैक्स चोरी करने बाले व्यवसायी देशद्रोही हैं
और इनको कडा दंड मिलना ही चाहिए अतः मैंने लखनऊ परिक्षेत्र के सभी फोटो
स्टूडियो पर छापा मारकर इन टैक्स चोरो को दण्डित करने की मांग की है l

Dear Sir,
I want to draw your kind attention towards the following incidence
where huge sales services are being done by certain photographers and
photo-shops without paying mandatory Sales Tax ,Value Added Tax and
Service Tax.


On 10th August 2014 My daughter thought to give a return gift to all
of us in the form of studio shot snaps by taking us to a Photo shop
named Prem Color Lab and Studio. There six snaps were taken by the
service provider and my daughter paid 240 rupees for 6 snaps and 60
rupees for soft copies of these snaps. We asked the shopkeeper to give
us a valid receipt but he declined and instead gave us a bogus receipt
bearing no. 5718 scanned copy of both sides of which are attached.
When we insisted on issuing of a valid receipt, owner of shop asked to
give us the one at the time of delivery of snaps.


Today ( Saturday ) evening, I and my husband went to the said shop to
take the snaps. Though shopkeeper gave photos and soft copies to us
but when we insisted on a valid receipt, he declined.


All staff and owners gathered and pressurized us not to insist on a
receipt. When my husband said that he shall go to authorities to make
a formal complaint, the owner said that they were continuously
greasing the palms of the authorities concerned through their union
and none of the photographer around Lucknow issue any formal receipt
for their sales and services.


To best of the knowledge above named shop owners are hardcore
criminals and they run a racket in Lucknow and had been making various
sales of illegally imported cameras and providing photography
services without paying sales tax, Service and VAT to the Government.


Evading Sales Tax, Service and VAT is not a good practice on their
part and leads to corruption practice, revenue loss to State
Government and Republic of India.


My prayer to you is to Conduct the raid and seize the book of
accounts of above named shop owners, Investigate the matter and
recover the evaded tax, Penalize the shop owners for malpractice and
tax evasion as per the state rules, Verify the authenticity of the
bills issued by the above mentioned shop owners.

I may be given the due prize money as per state guidelines for
revealing this to the authorities.


I would also like to request that the acknowledgement for receipt of
this complaint and the name of investigating officer be provided to me
who will be looking in this matter, as there is every apprehension
that the information provided to me will be misleading due to
political pressure and bureaucratic contacts of shop owners.


I request you to kindly take cognizance of my complaint and verify the
sales and services and initiate action against above mentioned shop
owners for tax evasion if any.

In a suspicious and strange turn of events, after four years of investigations the Central Bureau of Investigation (CBI), suddenly filed a closure report in the Satish Shetty murder case on 11th August. CBI investigations led to a 10,000 page report; several trips abroad by the investigative agencies and almost zeroing on 13 culprits, which were giving an indication about solving the murder case of the Right to Information (RTI) activist. The CBI spokesperson on Monday told the media that the closure has been filed at the Wadgaon-Maval court as it could not find sufficient evidence to prosecute the accused persons.

Just to recall, the 13 accused persons were named by slain RTI activist Satish Shetty in a land grab case along the Pune-Mumbai expressway through forging of documents, in a first information report (FIR) lodged by him at the Talegaon police station in October 2009. The names included the high profile owner of Ideal Road Builders (IRB), Virendra Mhaiskar, who is close to several top notch politicians of Maharashtra, as well as a sub-registrar and others. It has been alleged that the subsequent brutal murder of Shetty on 13 February 2010, was closely linked to his lodging of his FIR of October 2009. In fact, the CBI stuck to this FIR as the motive for Satish Shetty's murder for a good four years, until as recently as 8 August 2014 and then suddenly changed course in the last three days.

The High Court had suo motu taken cognizance of Satish Shetty murder in 2010 and directed the CBI to probe it, which was otherwise being investigated by the Pune Rural Police. It had again, on 8th August, allowed the CBI to open up the land scam case in which, Shetty had lodged an FIR. In fact, CBI itself had made this requisition to the High Court, stating that it (the land scam) might be linked to the Satish Shetty murder and hence needs to be re-investigated. The High Court on 8th August, directed the agency to go ahead with the re-opening of the case and submit its report within four weeks. However, instead, the CBI submitted a closure report at Wadgaon–Maval court on the basis that there is no evidence against the 13 accused. All this in a matter of just three days, that is between 8th and 11th August 2014!

Moneylife spoke with Sandeep Shetty, brother of Satish Shetty who is doggedly pursuing the case to seek justice. Here are the excerpts from the interview...

Moneylife (ML): How do you react to CBI's sudden closure of your brother, Satish Shetty's murder case?

Sandeep Shetty (SS): It is very shocking that the CBI should have made a turnaround in three days flat. Where is justice left? Earlier, we thought the local police might be influenced by some higher-ups, but now the CBI too has bent backwards to please those in political power. It is impossible for the investigative agency to take action on its own, as the High Court has directed on 8th August that it should submit the report to it in four weeks time. Even if you say that suddenly no evidence was found, the CBI cannot file a closure report; it should have submitted such a report to the High Court. This is clear case of contempt of Court and hence the closure report is invalid. In fact, the Wadgaon-Maval court has no powers to accept the report, which needs to be submitted to the District Court that in turn has to call me for hearing before accepting the report. I am going to contest it (the CBI action) and it will indeed be the biggest scandal if the District Court accepts the closure report. I'm also going to Wadgaon-Maval Court today to get the copy of the closure report. I am also going to file a petition to the High Court to re-investigate the case. I would be talking to my lawyer for advice.

ML: You have directly alleged that the closure is a result of political clout. Why do you say so?

SS: That's because the CBI has been investigating the case since the last four years and on 20 December 2013 it specifically told the High Court that Satish's murder is directly related to the FIR Satish has lodged against Mhaiskar and others in 2009. Again, a few days back, on 8 August 2014, the CBI told the High Court that prima facie Satish's FIR is the basic motive for his murder. This gave me hope that the case was on its way to getting solved and the culprits would be booked and punished as per Law. However, what else can one derive when in three days flat the CBI completely changed its stance and said that there is no circumstantial evidence against the accused, who were very much the accused until 8 August 2014.
We all know Nitin Gadkari's links with the the Ideal Road Builders-IRB group of companies and it's all in the public domain wherein IRB had loaned large amounts of money to Gadkari's controversial Purti group of industries. Hence, I strongly feel that Gadkari's pressure on the CBI resulted in the latter doing a complete u-turn unlawfully.  Would you believe that any government agency can do such a startling and brazen turnaround on its own, especially when it was sticking to its ground for a good four years?

Satish Shetty murder: clueless about killers, CBI files closure report


Four years after Right to Information activist Satish Shetty was brutally murdered outside his home in Talegaon, the Central Bureau of Investigation on Monday, submitted the closure report in the case, naming no killers and sparking shock and disbelief among RTI activists.

After a byzantine, drawn-out investigation and a charge sheet running into more than 10,000 pages, the CBI submitted the report at the Wadgaon Maval court, 45 km from Pune.

"I am utterly crushed…the High Court's directive had offered me some hope. Despite the succour given me by the CBI's investigating officer, it is quite obvious that powerful forces have pressurized the agency to submit the closure report, and this at a time when the CBI was on the verge of finishing their investigations," said a disconsolate Sandeep Shetty, his brother, commenting that "the change in government at the Centre had played a decisive part" in influencing the CBI's decision.

Mr. Sandeep Shetty said he would appeal to the Bombay High Court.
The High Court on Sunday had allowed the CBI to re-investigate Mr. Satish Shetty's complaint of alleged land-grab against Virendra Mhaiskar, chairman and managing director of Mumbai-based Ideal Road Builders (IRB) Infrastructure Developers Limited.

Mr. Shetty had lodged a complaint with the Lonavala city police against 13 people, including Mhaiskar and a sub-registrar, on October 15, 2009, accusing the company and its subsidiary, Aryan Infrastructure Investment Pvt. Ltd., of grabbing government and private land in Maval Taluk by forging documents and manipulating land records.

The IRB group was alleged to have extended huge unsecured loans to Union Minister Nitin Gadkari's Purti Sugar and Power Pvt Ltd.

The company had scuppered plans to develop a mega township near Kamshet off the Mumbai-Pune Expressway after it came under the scanner for its alleged involvement in Mr. Shetty's murder, who was hacked to death by assailants on January 13, 2010.

However, the local police had filed a closure report in September 2011 citing inadequate evidence.

The case was transferred to the CBI on April 6, 2010 after Mr. Sandeep Shetty moved the High Court.

The agency's stunning volte face has outraged activists.
"It is simply incredible that after interrogating nearly 900 persons, conducting several polygraph tests and even arresting some suspects, the CBI has simply shut the case. What justice and security is there for common people in such a climate?" said city-based RTI activist Vijay Kumbhar.
